Commercial Conveyancing covers property work where businesses are involved and includes such matters as:

  • Rent Reviews
  • Renewal of leases
  • Dilapidations
  • Use of premises
  • Building control
  • Property purchase

The normal situation is that such businesses will become either landlord or the tenant of a shop or office or they may already be in that situation. The parties will normally have their relationship governed by the terms of a business lease.

A business can consist of any number of people involved in a commercial venture whether it be a sole trader or a large public company.

A business lease is a complex document and businesses would be advised to seek the help of solicitors who specialise in this field before agreeing to such a document.

Some aspects of residential conveyancing are included in the field of Commercial Conveyancing such as the need to make searches and registration at the Land Registry for all leases of over 7 years in duration granted after 13th October 2003 irrespective of whether they are commercial leases or residential leases. There could be Planning considerations which need to be taken into account of which more is mentioned below.

Other aspects of residential conveyancing which enter the field of Commercial Conveyancing are where large estates of houses or flats are sold to individual purchasers. The conveyancing for the individual purchaser would be residential but the conveyancing by the seller and developer of the estate would be regarded as commercial conveyancing.

Planning


Planning is a branch of Commercial Conveyancing but it can be a matter which arises separately. It is a complex field of law and regulates the use of property ranging from simple use of a garage to complex and multi use of a large site where the Local Authority have agreed to a planning uses or uses in return for a developer carrying out some duty.

Breaches of planning requirements can lead to enforcement notices where the Local Authority can require uses carried on to cease. Other measures may include being summonsed before Magistrates and also injunctions.

This area of the law is not for the feint hearted to dabble in and expert advice should be sought at all times.
